The conditions applying to assessment requests, specialist visits and careful-opening work presented through Brassward.
1. Scope and operator
These Terms & Conditions govern use of the Brassward website and enquiries made to Electric Opening Skylights LTD about the careful opening of antique locks, old safes, chests and closed storage. The operator is Electric Opening Skylights LTD, 39 Recreation Avenue, Harold Wood, Romford, RM3 0TD, VAT ID GB 232253639.
The website presents the service and provides a route to request preliminary assessment and a specialist visit. The service itself is subject to assessment of the particular object and confirmation of the client’s right to the property.
2. Enquiries are not automatic acceptance of work
Submitting the enquiry form asks Electric Opening Skylights LTD to consider the request. It does not itself create an obligation on the company to open the item or guarantee that a specialist will determine that the work can proceed. Information supplied by the client must be accurate enough to allow a meaningful assessment of the request.
A photograph may support a preliminary assessment, but it does not replace any inspection considered necessary and does not replace confirmation of the client’s right to the property.
3. Property-right verification
The company will not carry out opening work unless it is satisfied that the client has the right to the property concerned. The client is responsible for providing information reasonably requested for that purpose and for ensuring that the request does not infringe another person’s rights.
If the company cannot be satisfied as to the client’s right to the property, it may decline to proceed with the opening work. This condition applies regardless of the condition, age or apparent value of the locked object or its contents.
4. Assessment and limitations
Antique locks, old safes, chests and closed storage can differ substantially in age, condition, construction and prior wear. The company therefore does not promise a particular opening method, a particular preservation result or a successful opening before the object has been assessed.
The aim of the service is careful access with preservation of original fittings and contents in mind where circumstances allow. The specialist’s assessment determines whether the proposed work is appropriate and what limitations should be taken into account before the client confirms that the work should proceed.
5. Pricing and agreement of work
The website does not publish a single generic price because the service depends on the object and the assessment required. Any price or service terms are confirmed separately in connection with the specific request after the relevant information has been considered.
No payment terms are created merely by submitting the website form. Where work is agreed, the applicable scope, price and any relevant conditions are those confirmed for that service before it is carried out.
6. Client responsibilities
The client must provide accurate contact and object information, must not request access to property they are not entitled to access, and must disclose relevant circumstances that could affect lawful or safe performance of the requested service. The client should also ensure that the specialist can inspect the object and surrounding area where an on-site visit has been arranged.
7. Liability and consumer rights
Nothing in these terms excludes or restricts liability where it would be unlawful to do so, including liability that cannot be excluded under applicable consumer law. Nothing in these terms is intended to reduce statutory rights available to consumers under the laws of England and Wales, including rights relating to services under the Consumer Rights Act 2015.
Because the condition and construction of old mechanisms can only be assessed in context, the company is not responsible for assumptions made by a user about the likely method or outcome before a specialist assessment has taken place.
8. Website information
The service descriptions on this site explain the company’s assessment-led approach. They are not a technical diagnosis of any particular lock, safe, chest or storage mechanism. Users should not treat general descriptions as confirmation that a particular item can be opened in a particular way.
9. Force majeure and matters beyond reasonable control
The company is not responsible for delay or failure to perform an agreed service to the extent caused by circumstances beyond its reasonable control. Where such circumstances affect an arranged service, the company and client may need to agree a revised arrangement.
10. Governing law and changes
These terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply. Disputes are subject to the jurisdiction of the courts that have authority under applicable law.
